Justice for Gaza (Droit pour Gaza – Recht voor Gaza) is a collective composed of jurists, lawyers and university professors, working alongside Palestinian victims, the Association belgo-palestinienne (ABP) and the Coordination Nationale d’Action pour la Paix et la Démocratie (CNAPD) against the Belgian State, because of its inaction in the face of the crimes committed by Israel.

Motives for the action

Since the bloody attack by Hamas almost two years ago, Gaza has been the scene of a large-scale massacre, amply documented and condemned by the highest international bodies, including the International Court of Justice.

Like all signatories to the Convention on the Prevention and Punishment of the Crime of Genocide, Belgium has a legal obligation to act to prevent the irreparable.

The Belgian State has a duty to mobilise all legal means at its disposal to prevent and stop these crimes.

This is not an opinion or a political choice, but a legal obligation.

There is no doubt about the extreme urgency of the situation. Yet Belgium has failed to adopt measures that meet these imperatives; it even continues, through some of its actions, to encourage, and at the very least to tolerate, the systematic violations of international law and international humanitarian law by the State of Israel.

Claim

The plaintiffs claim that Belgium be ordered to take, as a matter of urgency, the following measures required under international law due to Israel’s systemic violations of international humanitarian law, genocide in the Gaza Strip and illegal occupation of the Palestinian Territory:

the closure of its land and airspace to the transport of weapons or military equipment destined for Israel;
the prohibition of all trade with Israeli settlements in occupied Palestinian territory, and, more broadly, of any investment that helps maintain Israel’s illegal occupation of Palestine and the prohibition of all import of products or commodities from Israel’s illegal settlements in Palestine;
the denunciation, in subsidiary order suspension, by Belgium of the Euro-Mediterranean Agreement establishing an association between the European Union and their Member States, and the State of Israel.
